Pursuant to Sections 41721 and 41760 of the California Public Resources Code, the CSE shall be approved by the County and by a majority of the cities within the County, which contain a majority of the population of the incorporated areas of the County. In addition, cities are required to approve or reject the CSE, independently, within 90 days of receiving it from the County. State law provides that if a city does not take action within that time period the city will have been deemed to have approved the document.
As directed by the Board, the Los Angeles County Revised Countywide Siting Element (Revised CSE) and their associated environmental documents were distributed to the 88 cities in Los Angeles County for the statutory 90-day approval period which ended on December 12, 2022. As of that date, 87 cities approved the Revised CSE either by resolution or tacit approval as provided by Section 41760 of the Public Resources Code. On May 23, 2023, the County of Los Angeles Board of Supervisors (Board) conducted a duly noticed public hearing and adopted a resolution approving the Revised CSE. Following the Board’s approval of the Revised CSE and pursuant to the Code of Regulations, Title 14, Section 18784, the Board instructed the Director of Los Angeles County Public Works, acting as the lead agency, to submit the Revised CSE to California Department of Resources Recycling and Recovery (CalRecycle) for approval. On November 21, 2023, the CalRecycle, at a public meeting, approved the Revised CSE.
The Revised CSE, approved by the majority of the cities within the County which contains majority of the population, the Board of Supervisors, and CalRecycle will replace the existing CSE that was approved by California Integrated Waste Management Board (CIWMB), predecessor of CalRecycle in 1998.
